: : : : A mining company has filed a petition in Armstrong Co. court to take the disputed Rails to Trails right away through eminant domain.
: : : : http://www.pittsburghlive.com/x/leadertimes/s_530930.html
: : : : Either the mining company is working with AVLT, fearing another court defeat, to finally defeat the 100 property owners or the mining company is giving AVLT a dose of their own medicine. How much taxpayer grant money was already put into that project, while the truckers & rural residents along interstate 80 are being asked to pay for Urban Mass Transit because the State needs more transportation money? (they spent the money needed to fix the bridges & highways on Mass Transit & now say they need the tollroad to fix the bridges & highways... they also built new stadiums & upgraded infastructure in the Urban areas, while the truckers & rural residents get to pay the toll) Too bad they didn't use the money used for the trails to pave the street in FC instead, huh?
: : : : In any event, the real losers here are going to be the taxpaying property owns. Isn't that how 'the system' always works though? The big guy gets the bounty & the little guy gets the bill. But have no fear, after the little guy goes broke because he can't pay the bill any more he will be able to become 'an abuser of the system' and take advantage of all the wonderful government programs available. After all, the Government is here to 'Help' you, right?
: : : Yep. Agree 100%.
: : : I like also how "Property owners have 30 days to file an objection or forfeit their rights. "
: : : Why on Earth should the property OWNERS have to do ANYTHING to keep THEIR property? This is just freakin' RIDICULOUS!
: : : That's "eminant domain" for ya though. This was ORIGINALLY supposed to be reserved just for government projects. But now they can do it for any purpose, if it supposedely helps the area.
: : : I don't feel they should be able to do this for a private corporation AT ALL. But if they do, the property owners should be GREATLY compensated. I'm talkin' like triple what the property is worth.
: : : Rosebud isn't doin' this just for the hell of it. You can bet you ass if they want to put in a railway as opposed to hauling the coal by truck, they are going to be saving millions, if not 100's of millions of dollars. Therefore the property owners should be compensated accordingly.
: : : Now if this were for some government project, that would be a different story. But it's not. This projects sole mission is to make Rosebud more money. I can't say as I blame them for it, buyt compensate the land owners.
: : : In fact, it is my opinion that Rosebud shouldn't even be attempting this emminant domain crap. They should just go along there and buy all the properties. They have the money to do it.
: : : Hell, they'll probably spend more on the locomotive than all than land is worth.
: : : One other thing though...Is a 66 foot wide swath really neccessary? In fact, it MAY even be wider than that. In two separate articles in the LT, one said "33 feet on either side OF THE RAILWAY" and the other said "a 66 foot wide corridor". Call it splittin' hairs if you want, but if the "corridor" is the width of the trains, that could make the whole thing closer to 90 feet wide in the portion with 2 tracks. That's hardly needed.
: :
: : And then they are going north above Kittanning and out to Indiana, through Ford City, Manorville etc.. Way to go Rosebud..
: It wouldn't surprise me.
: Here's a poser though. Old Cliffy could probably sell all the coal he could dig up at Logansport to the power plant up the river at Reesdale.
: Why not just dump all that coal onto barges and shove it up the river? That would almost have to be cheaper than building and maintaining a railroad, wouldn't it?
: Nobody's property would be stolen.
: No noisy, dirty trains.
: Everybody's happy!
: Oh, that would even keep the channel opened up so we wouldn't have the anual reports from Scahill about the ice jams on the river.
This railroad is looking better and better, industry might even think about coming if we have a railroad, with Rt28 being messed up we could ride the train to work in Pittsburgh, all sorts of possibilities.
